(hereinafter referred to as the "Policy")

The controller of personal data is Ekoenergdevelopment, s.r.o., with registered office at Lublaňská 646/59, Vinohrady (Prague 2), 120 00 Prague, ID No.: 03899233, registered in the Commercial Register kept at the Municipal Court in Prague under file number C 239348. Hereby, as a personal data controller, it provides information on the purposes, means and methods of processing personal data, including information on the rights of individuals whose personal data are processed.

The Data Controller ensures the processing of personal data of individuals in accordance with applicable national and European Union law, in particular in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 concerning the protection and processing of personal data of natural persons and the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

1. Legal basis for the processing of personal data

We process personal data on the basis of the following legal grounds:

• Performance of a contract: the processing is necessary for the performance of a contract we have with you, as well as for the performance of the measures leading to the conclusion of this contract pursuant to Article 6(1)(b) GDPR),
• Consent: to processing for the purpose of providing direct marketing (in particular for sending commercial communications and newsletters) pursuant to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services,
• Compliance with legal obligations: processing is necessary for compliance with legal obligations to which the controller is subject pursuant to Article 6(1)(c) GDPR,
• Legitimate interest: where processing is necessary for our legitimate interest pursuant to Article 6(1)(f) GDPR

2. Purpose of the processing of personal data

We use your personal data mainly for the following purposes:

• To provide our services: to enter into and perform contracts and to provide services you have requested (e.g. sending you information about projects, responding to enquiries, processing orders).
• Improving our services and website: to improve our products and services based on analysis of the use of our website and interactions with users.
• Marketing and communications: if you have given us your consent, we may send you information about our news, events, service offerings and products that may be of interest to you.
• Compliance with legal obligations: to comply with legal obligations, such as keeping records for tax purposes, or if required by legal or regulatory authorities.

3. What personal data do we process?

We process the following categories of personal data:

• Identification data: for example, first name, surname, academic degree, date of birth, ID number, VAT number, data from identity documents.
• Contact data: email address, telephone number, home address.

• Data about your interactions with us: communications via emails, phone calls, messages or in face-to-face meetings.
• Other data: bank account number, CCTV images.

4. Collection of personal data

We collect personal data in several ways:

• Automatically: through cookies and other technological tools we use to analyze traffic to our website and improve the user experience.

5. Retention period of personal data

• We only retain your personal data for as long as necessary to achieve the purposes for which it was collected. This includes the period of time for which the data must be retained to comply with contractual or legal obligations. After this period, we will securely delete or anonymise the data.
• If you provide consent to the processing of personal data, the seller will only retain your data until you withdraw this consent.

6. Recipients of personal data

• Your personal data is only processed by our employees and contractors who are bound by confidentiality obligations. Your data may also be shared with third parties if this is necessary for the performance of our obligations or if this is permitted by law.

7. Right of access to processed personal data

• If you wish to obtain information about the personal data that the controller processes about you, you have the right to contact the controller at any time to request details about the processing of that data.
• Upon your request, the controller will provide you free of charge with detailed information about the processing of your personal data or send you a copy of it.
• The right of access to the personal data processed is governed by Article 15 GDPR

8. Other rights

• You have the right to rectification of personal data processed about you by the controller if it is incorrect.
• You have the right to have your personal data processed by the controller about you erased. You only have the right to have your personal data erased if one of the following reasons applies:

1. the data is no longer necessary for the purpose for which it was processed,
2. you have withdrawn your consent to the processing of the data,
3. objections to processing have been raised pursuant to Article 21(1) GDPR and there are no overriding legitimate grounds for processing or objections to processing have been raised pursuant to Article 21(2) GDPR,
4. the data have been unlawfully processed,
5. the data must be erased to comply with a legal obligation, or
6. the data have been collected in connection with the offer of information society services.

• You have the right to restrict the processing of personal data. In order for the processing of data to be restricted, it must be one of the following cases:

1. You contest the accuracy of your personal data,
2. the processing of the data is unlawful but you refuse to erase such personal data,
3. you request the processing of personal data for the purpose of exercising your claims, even though the purpose for which the controller processed the data has already been fulfilled,
4. you have objected to the processing and it has not yet been established whether the legitimate interests of the controller outweigh your legitimate interests.

• You have the right to object to the processing of personal data, in particular you have the right to object:

1. to the processing of personal data concerning you by the controller for the performance of a task carried out in the public interest or in the exercise of official authority vested in the seller,
2. against the processing of personal data about you by the controller on the basis of its legitimate interest,
3. against the processing of personal data where we process your personal data for direct marketing purposes. In this case, your personal data will no longer be processed.

• You have the right to the transfer of personal data, i.e. you have the right to obtain the personal data concerning you that you have provided to the controller in a structured, commonly used and machine-readable format and the right to transmit this data to another data controller without hindrance from the controller to whom the personal data was provided. Such a transfer can only take place if:

1. the processing is based on your consent or a contract; and  
2. the processing is carried out by automated means.

• You have the right to withdraw your consent to the processing of your personal data at any time.

1. Withdrawal of your consent does not affect the lawfulness of processing based on consent given before its withdrawal. Withdrawal of consent also does not affect the processing of personal data that the controller processes on a legal basis other than the consent you have given.

• In the event of exercising any of the above rights, the seller is entitled to require proof of your identity.

9. Complaint about unlawful processing of personal data

• If you believe that your right to protection of personal data has been violated, you have the right to file a complaint against the seller with the Office for Personal Data Protection.

10. Protection of personal data

• We take technical, organisational and security measures to ensure that your personal data is protected from unauthorised access, misuse, loss or damage.

11. Transfer of personal data to third countries

• We do not transfer your personal data to countries outside the European Union (EU) and the European Economic Area (EEA) unless it is necessary to provide our services. In the event that we need to transfer data to a third country, we will ensure an adequate level of protection for your personal data.

12. Changes to this policy

• This Privacy Policy may be updated from time to time. We will notify you of any changes by posting the new version on our website. We encourage you to check this page periodically to keep informed of any changes.
